1. Acceptance of Terms

By accessing or using the WeMerchant platform ("Service"), operated by LYTEK LLC ("Company", "we", "us"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service.

2. Description of Service

WeMerchant is a multi-merchant SaaS platform that enables local merchants to receive online orders, process payments, and manage order fulfillment (pickup and dine-in). Customers may browse merchant stores, place orders, and make payments through the platform.

3. SMS Terms

By providing your phone number and completing an order on the WeMerchant platform, you agree to receive transactional SMS text messages from LYTEK LLC (operating as WeMerchant). These messages include order confirmations, order status updates, and related notifications.

• Message Frequency: Varies by order activity; typically 1–3 messages per order.
• Message & Data Rates: Message and data rates may apply. Check with your mobile carrier for details.
• Opt-Out: Reply STOP to any message to cancel. After opting out, you will receive one final confirmation message and no further messages will be sent.
• Help: Reply HELP to any message for assistance, or email us at mylytek@gmail.com.
• No Third-Party Sharing: Your phone number will not be shared with third parties for marketing or promotional purposes.
• Supported Carriers: Major US carriers including AT&T, T-Mobile, Verizon, and others. Carrier support may vary.

4. User Responsibilities

• You must provide accurate contact and order information.
• You are responsible for any orders placed under your phone number or email.
• You agree not to use the Service for any unlawful or fraudulent purposes.
• You must be at least 18 years old to use the Service.

5. Orders and Payment

• All orders are subject to merchant availability and acceptance.
• Prices displayed are in USD and include any applicable merchant-set fees.
• Payment is processed securely by Stripe. By placing an order, you agree to Stripe's Terms of Service.
• Refunds are subject to the merchant's cancellation policy and applicable law.

6. Order Cancellation

Customers may cancel orders subject to the following:

• Regular orders: within 3 hours of placement.
• Group buy (campaign) orders: up to 10 minutes before the campaign deadline.
• Cancellations after these windows are at the merchant's discretion.

7. Merchant Accounts

Merchants who register on WeMerchant agree to provide accurate business information, comply with all applicable laws, and honor confirmed orders. Merchants are responsible for their product listings, pricing, and fulfillment. LYTEK LLC reserves the right to suspend or terminate merchant accounts that violate these Terms.

8. Limitation of Liability

To the fullest extent permitted by law, LYTEK LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid for the relevant order.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee uninterrupted or error-free operation of the Service.

10. Governing Law

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
